Former pediatrician Earl Bradley’s fate now rests in Superior Court Judge William Carpenter Jr.’s hands after just one day of testimony.
Attorneys from both sides began the trial, Tuesday, with an agreement that consolidated the original 470 charges into 24. Those 24 consisted of 14 first-degree rape, 5 second degree assault and 5 sexual exploitation of a child charges.
The defense called no witnesses nor cross examined either of the two called by the prosecution. Defense attorney Dean Johnson’s only gesture was to note his objection to the video evidence.
“It’s a continued objection,” he said.
Prosecutor Paula Ryan’s chief witness – Delaware State Police Detective Scott Garland with the High Technology Crimes Unit – painted a gruesome picture of evidence obtained by warrant at both Bradley’s Baybee Pediatrics office and home. Some of the video evidence, Garland said, showed victims losing consciousness. Bradley picked one victim up by only the head and slung her on a couch four feet away after nearly choking her to death by forcing her to perform oral sex on him, Garland alleged.
Several in the crowd that began as nearly 60 people were in tears throughout the testimony, and even Garland admitted it was “something I was not prepared to see” when he referred to the video evidence.
“I’ve never yelled at a computer screen before, but there was a time when I yelled ‘get off her,’” Garland said of one instance where a victim appeared to lose consciousness on film. “It was like nothing I’ve ever seen before.”
Garland added that in most cases of child pornography, those filming try not to show either the victim’s or their own face on camera, however, Bradley seemed to make it a point to do the opposite on most videos.
Some of the alleged rapes occurred with victims’ parents in the same room, typically with Bradley and the victim behind drapes and disguised as routine examinations. The more brutal attacks, Garland said, occurred in what the prosecution referred to as “Room ‘B,’” which was in a separate building from the main clinic and was used as Bradley’s personal office. After some of those alleged attacks, Bradley could be seen on video forcing a Popsicle around the outside of a victim’s mouth to conceal damage that may have taken place, Garland said.
On the video evidence, which was placed on an external hard drive to be examined by Carpenter, Garland said there were 89 incidents with 86 different victims. One victim is shown on four separate occasions. The average age of all the identified victims, Garland said, was just more than three years old, and included in that average was a pair of 14-year-old girls.
No time frame for a verdict in the case was given, as Carpenter said he would notify both teams once one was reached and it would be read in open court.
